Your site mentions that SQL Server Developer edition can be used
for software development and testing, but a software developer whom I
have approached says its not legal to use SQL Server Developer edition
for development in a software consultancy. Please clarify.

Hi Ashish, in terms of licensing questions, it is always best to get an official answer through the Microsoft licensing folks as opposed to through the forums. Here's the info if you want to give them a call to get the supported answer:
For Licensing questions : Call (8004269400), Monday through Friday, 6:00 AM to 6:00 PM PST to speak directly to Microsoft licensing specialist.

Hi,
You must speak to Licesning expert as Sam mentioned but AFAIK you can use Puchased Dev edition for developement purpose but cannot use it in production.
Edit: Express edition is free of cost and can be used in production. Its available online for download as well

You can use SQL Express for any kind of use with it's restrictions (on cpu, memory, size etc). SQL Developer Edition is a full version with all the features enabled but can be used only for academic (e.g. a learning student) and generally development scenarios.
