Legacy metro tile not created in the start menu

Hi there,
I have an issue with creating metro tile for the legacy application in Windows 8. Is there a way to create the tile during the installation in Audit mode? In Windows 7 we used shell script to create it. Now, while in Audit mode, installation creates the tile and it is visible in Audit mode. Unfortunately after the OOBE mode the tile is no longer available. Any suggestions? This is needed since our product gets installed by OEM's and they do their installation in Audit mode.

By legacy application are you referring to desktop applications?
